Terms and Conditions for LinkUp Ja Services

1. Acceptance of Terms

We are not a bank or a financial institution and do not hold funds directly. All transactions are facilitated through licensed third-party financial service providers.

5. Transaction Rules and Limitations

• All transactions are subject to limits imposed by LinkUp Ja or our third-party partners.
• You agree to ensure all information provided for transactions (e.g., recipient details, amount) is accurate. LinkUp Ja is not responsible for losses incurred due to incorrect information provided by you.
• Transactions may be subject to fees, which will be clearly disclosed to you before completing any transaction.
• LinkUp Ja reserves the right to suspend or cancel any transaction if we suspect fraud, money laundering, or any other illegal activity, or if required by law or regulation.

• Engaging in any activity that could disable, overburden, damage, or impair the Services.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LINKUP JA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

9. Indemnification

You agree to indemnify and hold harmless LinkUp Ja, its affiliates, directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with your access to or use of the Services or your breach of these Terms.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Jamaica, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms or the Services shall be resolved in the courts of Kingston, Jamaica.
